CHAMPAIGN, IL (Chambana Today) – The U.S. Supreme Court has agreed to review a lawsuit led by Illinois Republican U.S. Rep. Mike Bost challenging the state’s mail-in voting law. The law permits mail-in ballots postmarked by Election Day to be counted up to 14 days afterward.
Bost and two former presidential electors argue this provision violates federal law by effectively extending Election Day beyond the constitutionally mandated date. Lower courts previously dismissed the case, citing Bost’s lack of legal standing. The Supreme Court’s decision will focus solely on whether Bost has the right to sue, not on the merits of the mail-in voting law itself. A ruling in Bost’s favor could lead to a broader examination of the law’s constitutionality.
The Court is expected to hear arguments in the fall, with a decision anticipated by June 2026.
